In a recently published submission to the Justice and Home Affairs Committee’s call for evidence on new technologies and the application of the law, PLP has urged for an increase in transparency around Government use of algorithms to ensure they operate fairly, lawfully and in a non-discriminatory way.

Setting out why a lack of transparency – among other issues – surrounding the sham marriages algorithm and the prisoner categorisation algorithm is problematic, our evidence also considers options for a new legal framework to ensure new technologies operate fairly and lawfully, including:

  • A public register of high risk AI systems
  • Certification indicating conformity to regulatory standards
  • A requirement that the design of high risk AI systems allows for effective human oversight
  • A blanket ban on certain AI systems.
